Protecting The Rights Of The Injured

Louisville, Kentucky, Nursing Home Lawyers

Many times the elderly residents are placed in nursing homes because their families are unable to provide the consistent care and treatment that elderly nursing home residents require. Unfortunately, many times the elderly are physically abused once they are placed in nursing homes. As elders become more physically frail, they are less able and less likely to stand up to bullying or physical abuse.

Reports of the elderly being roughly handled, pushed, deliberately dropped, punched, kicked are reported with shocking frequency. Over 500,000 instances of elderly abuse are reported each year, with millions more going unreported.  It is important to inspect your loved one and ask questions each time you visit to determine if any signs of physical abuse are present. The physical signs or records of abuse might be the only hard evidence of injuries as bruises fade, cuts heal, and the evidence of physical injury disappears. There are many signs and symptoms of elder abuse or nursing home abuse, but these are several specific items to be aware of:

  • Bruises, black eyes, welts, and other marks from physical contact
  • Rope marks, rope burn, skin being rubbed raw, or other indicators of being restrained
  • Bone fractures, broken bones, sprains, dislocations, internal injuries, internal bleeding, closed head injuries, and skull fractures
  • Lacerations, open wounds, scraps, cuts, punctures, and untreated injuries
  • Broken eyeglasses/frames, physical signs of being subjected to punishment, and signs of being restrained
  • Findings or reports of medication overdose or under-utilization of prescribed drugs (Medication is empty before next prescription or more medication remains than prescription allowed if taken regularly)
  • Elder’s report of being hit, slapped, kicked, or mistreated
  • An elder’s sudden change in behavior
  • The caregiver’s refusal to allow visitors to see an elder alone.
